The petitioner seeks bail in a case registered for the offence under Sections 363, 366(A)/34 of the Indian Penal Code.

It is submitted on behalf of petitioner that the victim girl was examined under Section 164 Cr.P.C., wherein she has stated that she had gone voluntarily to the house of her Mausi at Tamil Nadu with her friend Vikram Kumar (petitioner), as her mother admonished her. She has specifically stated that nobody had kidnapped her. Petitioner has got clean antecedent and he is in custody since 29.07.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as statement of the victim girl recorded under Section 164

Patna High Court CR. MISC. No.57497 of 2021(3) dt.24-03-2022 2/2 Cr.P.C., the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Meenapur P.S. Case No. 264 of 2021.
