This application has been filed for quashing the order dated 14.02.2022 passed by learned Additional Sessions Judge VI cum Special Judge, POCSO, Sitamarhi in Suppi P.S. Case No. 157 of 2021 whereby and whereunder cognizance has been taken for the offences under Sections 341/323/354A/354B/ 452/504/506/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act. The age of the victim is 17 years.

Mr. Ashok Kumar Jha, learned counsel for the petitioner has vehemently argued this case.

All the materials which are being argued by learned counsel for the petitioner for quashing the order taking

Patna High Court CR. MISC. No.48625 of 2022(2) dt.23-03-2023 2/2 cognizance are materials which can be examined only during the trial.

Considering the facts and circumstances of the case and also the fact that the victim is 17 years of age, this application is dismissed.
