This is an application for anticipatory bail for the offence punishable initially registered under sections 302, 328, 120 (B)/34 of the I.P.C. thereafter charge sheet has been submitted under section 306/34 I.P.C.

Allegedly the petitioner who is husband of sister of the Informant Kulsoom Khatoon poisoned to death. Submission is that the deceased committed herself suicide and the petitioner has been falsely implicated, to which the learned A.P.P. opposed.

Considering that the deceased died in the house of the petitioner and after investigation charge-sheet has been submitted under section 306/34 I.P.C, this Court is not persuaded to grant

Patna High Court Cr.Misc. No.1708 of 2014 (7) dt.12-01-2015 2/2 privilege of pre-arrest bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner stands rejected in connection with Bajpatti P.S. Case No. 120 of 2012 pending in the court of S.D.J.M. Pupari at Sitamarhi.
