JUSTICE SANJAY PRIYA ORAL ORDER 22-11-2017 Heard learned counsel for the Petitioner and the State. The instant application has been filed for modification of the order dated 17.07.2017 passed by this Court in Cr. Misc. 31508 of 2017.

The Petitioner was allowed anticipatory bail by the order dated 17.07.2017 passed by this Court in Cr. Misc. 31508 of 2017 in which he was directed to surrender in the Court below within a period of six weeks from the date of order, but he could not surrender within time, as he was suffering from chronic kidney problem and was on bed rest when the order dated 17.7.2017 was passed. He was referred to CMC Vellore where he remained under treatment for long time. Hence, he prays that time be extended for further six weeks to surrender in the Court below. Patna High Court Cr.Misc. No.56427 of 2017 (2) dt.22-11-2017 2/2 granted to the Petitioner from the date of receipt/production of copy of this order to surrender before learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S. Case No. 342 of 2016 and in the event he surrenders in the court below within aforesaid period, he will be released on same terms and condition as mentioned in the order dated 17.07.2017 passed by this Court in Cr. Misc.31508 of 2017.
