The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No.58 of 2017 registered under Section 307 of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel for the petitioner submits that on the basis of the fardbeyan of the informant, the present case was lodged on 31.03.2017 against unknown, regarding sustaining firarm injury by him. Later on, in his restatement, the informant disclosed the name of the petitioner with the contention that he and the petitioner used to reside at Kota in connection with their study where the petitioner had taken Rs.15000/- from him but in
Patna High Court Cr.Misc. No.57754 of 2017 (2) dt.19-12-2017 2/2 spite of repeated request, the petitioner did not return the money to him. Due to that reason, the petitioner has falsely been implicated in this case by the informant. Further submission is that the petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sushant Ranjan, Additional Chief Judicial Magistrate-II, Patna City, Patna, in connection with Bahadurpur P.S. Case No.58 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
