2. The petitioners seek regular bail in connection with Rampur P.S. Case No. 193 of 2024 registered for the offence punishable under Sections-414, 420, 467, 468, 34 of the Indian Penal Code.
3. According to prosecution case, when S.H.O.- cumPolice Inspector, Rampur P.S. was conducting vehicle checking duty at Sikariya More, petitioners came there on a motorcycle, police gave a sign to stop but they tried to flee away, howerver they were apprehended. The motorcycle bears a number plate bearing number BR06B 3632 on back side of the motorcycle
Patna High Court CR. MISC. No.52557 of 2024(2) dt.01-08-2024 2/3 whereas the front side number plate was blank. When the motorcycle was verified through its chasis number by e-chalan machine, the actual registration number found as BR02AR 3441, registered in the name of one Dhirendra Singh, S/o Pavitra Singh of Vill. Aeru P.S. Wazirganj Dist. Gaya whereas his mobile no. was 8210301235. It is further alleged that registered owner Dhirendra Singh disclosed that he has lodged Civil lines P.S. Case No. 546/21 w/s 379 IPC regarding theft of the motorcycle and police of Civil Lines P.S. also confirmed the information given by registered owner. The key of the motorcycle is also said to have been recovered from the possession of petitioners. Petitioners are also said to have consumed liquor.
4. Learned counsel for the petitioners has submitted that the petitioner No. 1 is a person of clean antecedent. Learned counsel for the petitioners has further submitted that they are innocent and have falsely been implicated in this case. The only allegation against the petitioners is to be found in drunken state. The petitioners are in custody since 04-05-2024.
5. Learned counsel appearing for the State has opposed the prayer for bail.
5. Considering the aforesaid facts and circumstances,
Patna High Court CR. MISC. No.52557 of 2024(2) dt.01-08-2024 3/3 the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Excl. Spl. Excise Judge, Court No.1, Gaya in connection with Rampur P.S. Case No. 193 of 2024 subject to condition that the petitioners will cooperate in the trial and make themselves available as and when required by the trial court.
