Mr.Arun Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and the learned APP for the State through virtual mode in view of COVID-19.

The petitioner apprehends his arrest in connection with Raghopur (Rushtampur) P.S. Case No.111 of 2022 instituted under Sections 366A, 34 of the IPC. As per the FIR, the informant alleged that the accused person kidnapped his minor daughter and kept at a secret place. Subsequently, the victim girl was recovered and under Section 164 of the Cr.P.C, she narrated that she was taken up by unknown persons and confined in a room for 10-15 days whereafter they left and she came back home.

Taking into account that the minor girl has echoed the allegation made in the FIR about her confinement for 10-15

Patna High Court CR. MISC. No.48104 of 2022(2) dt.06-01-2023 2/2 days, this is not a fit case for grant of anticipatory bail which is accordingly rejected.

However, if the petitioner surrenders before the concerned court within four weeks from today, the learned court will take into account all the factors including the documents that the petitioner may put forward for grant of bail and decide the same on its own merit without being prejudiced by any of the observation made herein.
