JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report which was lodged on 29.03.2003. The accusation against the petitioner is that he gave farsa blow causing head injury to the deceased but from perusal of the impugned order, I find that police after investigation submitted final form showing the accusation untrue in respect of the petitioner whereas other F.I.R. named accused were charge sheeted. Subsequently, co-accused were put on trial and in curse of trial, the prosecution witnesses stated about the involvement of the petitioner in the alleged crime and on the basis of statement of prosecution witnesses, petitioner summoned

Patna High Court Cr.Misc. No.9753 of 2016 (2) dt.01-03-2016 2/2 under Section 319 of the Cr.P.C. The petitioner surrendered before the trial court on 08.01.2016 and prayed for bail but his prayer for bail was rejected.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Bhojpur at Ara in connection with Sessions Trial No. 250 of 2004 arising out of Udawant Nagar P.S. Case No. 36 of 2003.
