JUSTICE RAJESH KUMAR VERMA ORAL ORDER 16-02-2023 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the informant as well as learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Petitioner seeks bail in a case registered for the offences punishable under Sections 376, 302 and 34 of the Indian Penal Code.

According to prosecution case, accused persons, namely, Hare Krishna Murari and Shailendra Kumar Sinha has killed the daughter of the informant after committing rape on her.

No.48001 of 2022(4) dt.16-02-2023 2/2 Learned counsel for the petitioner submits that petitioner has clean antecedent and she has falsely been implicated in the present case. He further submits that the petitioner is not named in the F.I.R. and the name of the petitioner has been transpired on the basis of the confessional statement of the husband of the petitioner. The petitioner is in custody since 21.09.2022.

The learned counsel appearing on behalf of the informant as well as learned Additional Public Prosecutor on the basis of material available on record and the case diary, have vehemently opposed the prayer for bail of the petitioner and submits that sufficient material has come during investigation against the petitioner.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Patrakar Nagar P.S. Case No. 258 of 2022 pending in the court of learned Additional Chief Judicial Magistrate - VIII, Patna. Prayer is refused.
