JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 21.8.2014 in a case registered for the offences punishable under Sections 409,420 and 120B/34 of the Indian Penal Code and section 7 of the E.C. Act.
On secret information, the house of the informant was raided from where 88 bags of subsidy wheat and 13 bags of subsidy rice were recovered by the Marketing Officer, Town Area, Motihari.
It is submitted by the learned counsel for the petitioner that the accusation has been levelled on suspicion. The petitioner is not a dealer, hence, no offence under section 7 of the E.C. Act is made out. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
