The petitioner apprehends his arrest in Excise case No. 24 of 2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The learned counsel for the petitioner submits that recovery of 70 and half liter of liquor was made from the hut but the petitioner is not owner of the hut. The petitioner has got no criminal antecedent.

It appears from the prosecution report that Excise officials raided the hut of petitioner and from there huge quantity of liquor was recovered.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
