1. Heard learned counsel for the parties.

2. The petitioner has filed the instant application for grant of regular bail in connection with Sheohar P.S. Case no. 379/2022 registered under sections 366A and 34 of the Indian Penal Code to which section 363 of Indian Penal Code was added subsequently.

3. As per the prosecution case, the informant states that his minor daughter had gone for morning walk but did not return. It transpired that altogether 5 persons including the petitioner herein kidnapped her on a motorcycle. Informant further states that his daughter has been taken away by Raushan Kumar for the purpose of marriage.

4. It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R. are false and concocted. Even as per the FIR the allegation is against co-

Other FIR named co-accused persons, namely, Ashok Sah, Sanjay Sah and Munni Devi have been enlarged on anticipatory bail by order dated 11.8.2023 passed in Cr. Misc. No. 47714/2023. The petitioner has no criminal antecedent and is in custody since 24.4.2023.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent, having remained in custody since 24.4.2023 and grant of anticipatory bail to the three co-accused persons vide order dated 11.8.2023, the Court directs the petitioner to be enlarged on bail in connection with Sheohar P.S. Case no. 379 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar.
