The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case,12 litres of IMFL and 158.4 litres of country liquor was recovered. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 29.4.2022 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 12.8.2021.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.48126 of 2022(2) dt.28-09-2022 2/2 taking into consideration the allegation in the FIR, liberty granted to the petitioner in the earlier order of rejection dated 29.4.2022 and the petitioner having remained in custody for more than one year, the petitioner is directed to be enlarged on bail in connection with Gopalpur (Rangra O.P.) P.S. Case no. 73 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II - cum - Special Judge (Excise Act), Bhagalpur.
