02-03-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State. Today again, nobody appears on behalf of complainant/opposite party no. 2. On earlier occasion also i.e. on 24-02-2020, counsel for opposite party no. 2 was not present. The petitioner apprehends his arrest in Complaint Case No. 851C of 2016 registered for the offence under Section 498A & other allied sections of the Indian Penal Code. It is submitted on behalf of petitioner that petitioner is husband of the complainant and he is ready to keep his wife with full honour and dignity.
In view of aforesaid facts and circumstances, the provisional bail granted to the petitioner, vide order dated
Patna High Court CR. MISC. No.45306 of 2019(6) dt.02-03-2020 2/2 23-07-2019, is hereby confirmed on the following conditions: "(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
