The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 427, 436, 435, 447, 448 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 09.06.2020 petitioner along with six accused persons came at his door and said that his son had taken photographs of Pinky Kumari and on protest, it is alleged that accused persons assaulted the informant and his side with lathi

Learned counsel for the petitioner submits that since petitioner's side was angry with the fact that son of the informant had taken photograph of Pinky Kumari as such they had gone to teach him a lesson but there the informant instead of asking his son to seek forgiveness also started arguing with the side of the petitioners on account of which the occurrence took place. Learned counsel further submits that from perusal of the injury report of the injured from informant's side annexed as Annexure-3 to the anticipatory bail application it would manifest that the injuries are simple in nature. Learned counsel next submits that allegation of assault is general and omnibus in nature, no specific allegation has been alleged against any of the petitioners with regard to the assault.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners and in the nature of allegations as alleged, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand)
Patna High Court CR. MISC. No.58783 of 2021(2) dt.11-07-2022 3/3 each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Amba P.S. Case No. 34 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
