JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 1426/18, disclosing offences under Section 498(A) of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

Petitioner no. 1 is father in law and petitioner no. 2 is mother in law of the complainant and allegation against them is that they along with other accused persons subjected the complainant to torture with respect to demand of dowry and there is also allegation against petitioner no. 1 that he once tried to set the complainant on fire.

Submission of learned counsel for the petitioners is that

No.46481 of 2019(2) dt.26-07-2019 2/2 entire allegation is false and concocted and they are father- in-law and mother -in- law and have falsely been implicated in this case. It has also been submitted that they live separately from the complainant and her husband and they are ready to abide by any condition imposed on them for grant anticipatory bail. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate - Begusarai, in connection with Complaint Case No. 1426/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is further subject to the condition that they will cooperate in disposal of trial and make themselves available as and when required, failing which, the prosecution will be at liberty to move for cancellation of their bail bonds.
