JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-07-2019 Heard learned counsel for the petitioner and the State. The only grievance involved in the present writ application is non-supply of Memo of charge to the petitioner and without supplying the Memo of charge, the respondents have decided to keep 10% pension and 10% of the gratuity amount in abeyance.
Considering the aforesaid, the writ application is disposed of with a direction to the respondents to provide copy of Memo of charge to the petitioner at the earliest preferably within a maximum period of 30 days from the date of receipt/production of a copy of this order so that the petitioner
Patna High Court CWJC No.14539 of 2019(2) dt.22-07-2019 2/2 may file his reply to the Memo of charge (Prapatra- Ka) and thereafter the respondents should complete the proceedings in terms of Rule 43(b) of the Bihar Pension Rules at the earliest within a maximum period of four months from the date of service of Memo of charge (Prapatra- Ka).
With the aforesaid, the writ application stands disposed of.
