2. The petitioners are apprehending their arrest in connection with Ramnagar P.S. Case No. 151 of 2024 instituted for the offences under Sections 363 and 366(A) read with Section 34 of the Indian Penal Code and later on Section 4 of the POCSO Act has been added.
3. As per allegation, the marriage of the minor daughter of the informant was solemnized with co-accused Lal Babu Chaudhari. The petitioners are said to be mediator of the
Patna High Court CR. MISC. No.49870 of 2024(3) dt.09-12-2024 2/3 said marriage.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. Petitioners have no concern with the coaccused Lal Babu Chaudhari. He further submitted that the coaccused Lal Babu Chaudhary against whom the allegation of solemnization of marriage with the minor girl of the informant, has been granted regular bail vide order dated 27.08.2024 passed in Cr. Misc. No. 58896 of 2024. Petitioners are the distant relatives between both the parties and they are person of clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge-VII, Bettiah, West Champaran in connection with Ramnagar P.S. Case No. 151 of 2024, subject to
Patna High Court CR. MISC. No.49870 of 2024(3) dt.09-12-2024 3/3 the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
