The petitioner being the married sister of the husband of the victim is languishing in custody since 11.11.2015 in a case registered for the offences punishable under sections 304B/324/326/307/498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Accusation is of killing the niece of the informant by causing burn injuries after three years of marriage for nonfulfillment of dowry demand. It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the entire in-laws family and the petitioner resides at her matrimonial house. The

Patna High Court Cr.Misc. No.7106 of 2016 (2) dt.11-02-2016 2/2 thrust of accusation is against the husband of the victim and the investigation has already concluded. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-2 to the petition.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No.596/2015. (Dinesh Kumar Singh, J) Ashwini/- U T
