JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 06.11.2014 on the accusation that 1Kg Ganja was recovered from his conscious possession.

No doubt, in the year 1998 similar type of case was registered against the petitioner but submission on behalf of the petitioner is that the aforesaid case was registered against the petitioner about 17 years ago and between registration of the aforesaid case as well as present case, the conduct of petitioner was found satisfactory as no case had been registered against the petitioner between the above stated period.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.1481 of 2015 (2) dt.15-01-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge , Purnia / concerned court in connection with Special Case no. 17 of 2014 arising out of Purnia Sadar P.S.Case No. 551 of 2014.
