Mr. BINOD KUMAR 3 ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-12-2017 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 384, 307, 379, 506 and 509/34 of the IPC and Section 27 of the Arms Act. The prosecution case is that the informant was the sales man of liquor shop. On 31.05.2015 at 6.30 PM, four persons came and asked for five bottles of whisky when on demand of cost of the whisky, the accused persons started abusing and took away Rs. 20,000/- from the shop of the informant. It is submitted by learned counsel for the petitioner that the accusation is omnibus and general. The petitioner is the neighbour of the informant, hence he has been roped in the present case. A statement has been made in paragraph no.3 of the petition that apart from present one, the petitioner is also

Patna High Court Cr.Misc. No.59889 of 2017(2) dt.13-12-2017 2/2 involved in one other case, being Danapur P.S. Case No. 142 of 2013.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for bail of the petitioner, if he surrenders within a period of six weeks, in connection with Danapur P.S. Case No. 300 of 2015, pending in the court of learned ACJM, Danapur (Patna).
