JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that as per allegation some unknown miscreants committed theft of the truck of the informant. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner's name has figured during course of investigation in confessional statement of co-accused. Petitioner has got no criminal antecedent.

Considering the nature of allegation, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within

No.57923 of 2021(2) dt.04-07-2022 2/2 six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate X, Bhojpur at Ara in Sahar Police Station Case No. 105/2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
