2. The petitioner has preferred this application for grant of regular bail in connection with Barahat P.S. Case No. 249 of 2023S.T. No. 145/2025 (arising out of Barahat P.S. Case No. 249 of 2023) dated 30.10.2023 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 307 and 506 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, while the petitioner was constructing the house at the informant's land, upon objection, all the accused armed variously came and assaulted him causing severe injury. When the informant's sons came to rescue, they also assaulted them.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.46530 of 2025(3) dt.17-09-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case due to land dispute. There is general and omnibus allegation against the petitioner. The co-accused has already been granted bail by this court vide order dated 12.08.2025 passed in Cr. Misc. No. 47015 of 2025. Learned counsel has submitted that the injury of Mithilesh Yadav is simple in nature but injury of Kapil Deo Yadav is stated to be grievous in nature which is on left hand and the injury of Vidyasagar Kumar is hairline fracture in the base of 3rd metacarpal bones which is grievous in nature. The petitioner has 4 criminal antecedents and he is on bail in all the aforesaid cases as stated in para 3 of the bail petition. The petitioner is in custody since 10.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with S.T. No. 145/2025 (arising out of Barahat P.S. Case No. 249 of 2023), with following condition:-
Patna High Court CR. MISC. No.46530 of 2025(3) dt.17-09-2025 3/3 (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
