The petitioner apprehends his arrest in a case registered for the offence under Sections 379, 411, 414/34 of the Indian Penal Code.

Petitioner is not named in the F.I.R. Name of the petitioner has surfaced during course of investigation in the confessional statement of apprehended co-accused Mantu Yadav. It is further submitted that the alleged motorcycle is not stolen, rather the same was purchased by this petitioner from one Jai Prakash Mahto on Rs. 45,000/-, out of which, petitioner gave him Rs. 22000/-. and it was promised that rest money shall be paid by him (petitioner) only after receipt of original papers of the motorcycle and thus, no case under the aforesaid provision of Indian Penal Code is made out against this petitioner. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.57702 of 2021(2) dt.04-07-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Harsidhi P.S.
