JUSTICE MIHIR KUMAR JHA ORAL JUDGMENT 17-03-2015 Heard learned counsel for the parties as with regard to the following relief prayed in this writ application:- "Commanding and giving direction to the Respondents to pay all the due occurred in favour of the petitioner after the death of her husband who died during service tenure being a clerk in High School."

Having regard to the fact that the respondents having filed supplementary counter affidavit have explained that the payment of Rs. 14,822/- on the head of provident fund has been sought to be made to the petitioner by the Headmaster of High School, Birpur

Patna High Court CWJC No.2630 of 2014 (6) dt.17-03-2015 Barahiya, Lakhisarai, this Court taking into account that the petitioner has also been appointed on compassionate ground on 10.09.2014 and she is already working on the post of Prakhand Teacher, would now dispose of this writ application with a liberty to the petitioner to claim any further death cum retirement benefit of her husband, late Vinod Kumar as may still be admissible and permissible to her in law.

Subject to the aforementioned observation and liberty, this application is disposed of.

The personal appearance of Triloki Singh, D.E.O., Lakhisarai is hereby dispensed with.
