====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-12-2022 Heard Mr. Rajesh Kumar, learned counsel for the petitioner and Dr. Kumar Uday Pratap, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Khagaria Rail P.S. Case No. 68 of 2022 registered for the offence punishable under Section 414 of the Indian Penal Code 1860.

As per the First Information Report, Police intercepted the petitioner at Platform No. 2 of Khagaria railway station and recovered three Mobile Phones which are alleged to be stolen.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case with oblique

Patna High Court CR. MISC. No.48414 of 2022(2) dt.16-12-2022 2/2 motive. He further submits that the petitioner has got no criminal antecedent. He next submits that at the time of his arrest and recovery of Mobile Phones, he could not produce the papers of the Mobile phones recovered from his possession. The petitioner is in custody since 7.5.2022 and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 7.5.2022, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned J.R.M., Khagaria, in connection with Khagaria (Rail) P.S. Case No. 68 of 2022.
