Petitioner has filed the present writ application being aggrieved by warrant of arrest issued by the District Certificate Officer, Rohtas, Sasaram in Certificate Case No. 13 / 2018-19 requisitioned and filed by the Manager, South Bihar Gramin Bank, Branch- Kochas, District- Rohtas for recovery of loan amount of Rs. 946688.91/-.

2. The petitioner has taken a loan of Rs. 3 Lakh under the scheme of Kishan Credit Card (K.C.C.) in the year 2006 from South Madhya Bihar Gramin Bank, Branch- Kochas, DistrictRohtas. The petitioner failed to re-pay the loan amount and since 2006 only a sum of Rs. 46,395/- has been paid by the petitioner.

Learned counsel for the petitioner submits that the petitioner has not received any notice issued by the District Certificate Officer, Rohtas, Sasaram and was suddenly served with warrant of arrest issued in Certificate Case dated 15.11.2019. The petitioner is ready to file his objection before the District Certificate Officer, Rohtas, Sasaram within fifteen days from today and at the time of filing objection the petitioner shall deposit a sum of Rs. 2,00,000/- in the loan account.

4. Learned counsel for the Bank submits that petitioner intentionally did not pay the loan amount and during this period the petitioner has taken insurance claim through the Bank. Lastly the Bank has submitted a requisition before the District Certificate Officer, Rohtas, Sasaram for recovery of the loan amount.

Having considered the submissions made by the parties and the taking into consideration the nature of dispute, this writ application is disposed with direction to the petitioner to deposit a sum of Rs. 2,00,000/- in his loan account of South Bihar Gramin Bank, Branch - Kochas , District- Rohtas within fifteen days from today and shall also file objection within that period under Section 9 of the Public Demand Recovery Act, 1914 before the District Certificate Officer, Rohtas, Sasaram. If the
