JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 02.09.2014 in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

It is alleged that one transporter informed on the mobile of the informant that dead body of his brother is lying near petrol pump, when he went there and found the dead body of his brother with injury on the neck suggesting the case of throttling. The name of the petitioner sprang up during investigation in the confession of co-accused Pramod Kumar who had illicit relationship with the wife of the victim who got the victim killed at the hands of this petitioner, Mahendra Sharma and Lalan Tanti.

It is submitted by learned counsel for the petitioner that

No.2647 of 2015 (2) dt.22-01-2015 2/2 the whole accusation is based only on suspicion and Pramod Kumar, on whose confession the petitioner's name sprang up, has been granted bail by this Court vide Cr. Misc. No. 39671 of 2013. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner, be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Garhpura P.S. Case No. 36 of 2013. (Dinesh Kumar Singh, J) Amrendra/- U T
