The petitioner apprehends his arrest in a case registered for the offence under Section 379, 411/34 of the Indian Penal Code.

Petitioner is named in the F.I.R. and he was found moving around the place of occurrence till late night. It is submitted on behalf of petitioner that though, petitioner is named in the F.I.R., but no stolen article has been recovered from his possession and only on suspicion, he has been made accused in this case. It is further submitted that some of the similarly situated co-accused persons have already been granted anticipatory bail by this Court.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has got three criminal antecedent, out of which, two cases are of similar nature.
