The petitioner apprehends his arrest in Nauhata P.S. Case No.182 of 2018 registered under Sections 341, 323, 379, 385, 447, 504, 506 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that the accused persons cut bamboo from the orchard of the informant. Co-accused Ashok Yadav is alleged to have made firing. The accused persons took away ornaments as well as documents etc.

Learned counsel for the petitioner submits that the petitioner and the informant are co-sharers. There is dispute with regard to allotment of share in the bamboo. No occurrence

Patna High Court CR. MISC. No.44602 of 2019(2) dt.19-07-2019 2/2 as alleged by the informant took place. The panchayati was first convened but when the informant did not succeed in panchayat, the informant lodged this case.

Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa in connection with Nauhata P.S. Case No.182 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
