JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Sasaram (M) P.S. Case No. 732 of 2017, registered under Sections 147, 148, 149, 341, 323, 337, 448, 427, 307, 379, 504 and 506 of the Indian Penal Code.
The accusation is that 34 persons named in the F.I.R. including the petitioners forcibly armed with weapons attacked at the house of the informant, Ram Avtar Paswan. At that time, Shivjee Paswan, Jag Narain Paswan, Bhim Paswan, Maharaj Paswan, Laxman paswan, Bipin Paswan, Mantu Paswan and Sintu Paswan having rifle and gun in their hands shot fire with intention to kill him and entered in the house of the informant and forcibly
Patna High Court Cr.Misc. No.51815 of 2017 (2) dt.06-11-2017 took cash of Rs.20,000/-. In the meantime, Sonu Paswan and Sintu Paswan also took the ornaments of his wife and other family members of the informant.
Learned counsel for the petitioners submits that, in fact, on the basis of the application of the informant to remove the encroachment and demolishing the house of co-accused, Shivjee Paswan, police reached there and at that time protest was made by the villagers and due to dirty village politics the name of the petitioners have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sasaram at Rohtas, in connection with Sasaram (M) P.S. Case No. 732 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
