The petitioner seeks bail in connection with Udakishunganj P. S. Case No.52 of 2020, instituted for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 04.03.2020, charge-sheet has been submitted in this case and has antecedent of 11 cases. Allegation is of recovery of a loaded country-made pistol.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the case merely because of his antecedents and nothing was recovered from his

Patna High Court CR. MISC. No.57711 of 2021(2) dt.03-03-2022 2/2 possession.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Udakishunganj/ successor Court, Madhepura in connection with Udakishunganj P. S. Case No.52 of 2020, subject to condition that one of the bailors shall be the cousin brother of the petitioner namely, Sanjay Mandal. Learned counsel undertakes to remove all the defects within two weeks from today and in the event, if the defects are not removed within the time aforesaid, the case will be placed under the heading to be mentioned for recalling the order of bail.

The application stands allowed.
