2. This application, for grant of anticipatory bail, arises out of Muffassil P.S. Case No. 219 of 2020, disclosing offences under Section 364 of the Indian Penal Code.

3. The F.I.R. has been lodged by the informant stating that on 09.06.2020, her son aged about 13 years had gone outside for playing. However, he did not return and search was made, but she could not found her son. The suspicion has been raised against the F.I.R. named accused persons including the petitioner.

4. Learned counsel for the petitioner submits that the F.I.R. has been lodged after a delay of three months inasmuch as

Patna High Court CR. MISC. No.51989 of 2023(3) dt.06-12-2023 2/3 the informant's got missing on 09.06.2020 but the present F.I.R. has been lodged on 15.09.2020. He next submits that except the suspicion, no material has come against the petitioner suggesting his involvement in the present offence. The similarly situated co-accused persons have been granted anticipatory bail by co-ordinate Benches of this Court in Cr. Misc. No. 19664 of 2023 and Cr. Misc. No 11728 of 2022.

5. Learned counsel for the State submits that during the course of investigation, no substantial material has come against the petitioner and he has been made accused on the basis of circumstances.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that there is inordinate delay in lodging of the F.I.R. and the similarly situated co-accused persons have been granted bail by coordinate Benches of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.

7. This application is, accordingly, allowed.

8. Let the petitioner, Ravindra Mandal @ Ravindra Mahton @ Rabinder Mandal @ Rabindra Mahto, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.51989 of 2023(3) dt.06-12-2023 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Muffassil P.S. Case No. 219 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
