JUSTICE RAKESH KUMAR ORAL ORDER 09-11-2017 At the very outset, Sri Babu Nandan Prasad, learned counsel for the petitioners, in presence of Sri Narsingh Tanti, learned Addl. Public Prosecutor, submits that during pendency of this petition, petitioner no.3, namely, Sardar Veer Bhagat Singh @ Sardar Veer Bhagat @ Hanuman Singh @ Hanuman has already been arrested and, as such, the present anticipatory bail petition, so far as petitioner no.3 is concerned, has become infructuous.

Accordingly, the present petition, so far as petitioner no.3 is concerned, stands dismissed as the same has become infructuous.

After some argument, learned counsel for the petitioners, in

Patna High Court Cr.Misc. No.53120 of 2017(2) dt.09-11-2017 2/2 presence of learned Addl. Public Prosecutor, requests for disposal of the present petition, so that aforesaid two petitioners, namely, 1. Raju Kumar and 2. Devi Lal@ Debi Lal Singh may appear before the court below and pray for regular bail.

The prayer is allowed.

The petition stands disposed of with observation that if within six weeks from today, both petitioners, namely, (i) Raju Kumar and (ii) Devi Lal@ Dabi Lal Singh appear before the court below and make a prayer for regular bail, learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.
