JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 19.11.2014 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.
It is alleged that the son of the informant went to sleep in the community hall at the instance of Nemo Yadav. At about 2 AM in the night, Nemo Yadav informed the informant that his son has been murdered. It is alleged that Umesh Pandey, Rinku Pandey, Saryug Yadav and the son-in-law of this petitioner were also sleeping in the community hall. The name of the petitioner sprang up during investigation in the confessional statement of Nemo Yadav and Saryug Yadav.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.2645 of 2015 (2) dt.22-01-2015 2/2 co-accused Saryug Yadav, on whose confession the name of the petitioner sprang up, has been granted bail by this Court vide Cr. Misc. No. 19310 of 2006. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate Jamui in connection with Sono P.S.
