JUSTICE SANJAY PRIYA ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Supaul (Mahila) P.S. Case No.126 of 2017 instituted for the offence under Sections 493, 376, 354(D), 504, 506, 509 of the Indian Penal Code and under Sections 3⁄4 of the Dowry Prohibition Act.

There is specific allegation against the petitioner of committing illegal act with the informant on the pretext of marrying her. The statement of the victim girl was recorded under Section 164 Cr.P.C wherein she has stated that one of the friend of the petitioner Navin Sharma, stole nude photographs from mobile phone of the petitioner and made the same viral. Case diary has

Patna High Court Cr.Misc. No.53102 of 2017 (4) dt.19-12-2017 2/2 been received wherein the informant in her further statement has supported the case. The witnesses in Paragraphs 13, 14 and 15 of the case diary have supported the allegation. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.

The petitioner may surrender and make prayer for regular bail which shall be disposed of by the court below in accordance with law without being prejudiced by this order. (Sanjay Priya, J) N.H./- U T
