The petitioner apprehends his arrest in Complaint Case No.49C of 2017 registered under Section 498A of the Indian Penal Code.
The complainant named her husband, Prakash Paswan and all other her in-laws including the petitioner as accused in the complaint case. Petitioner is the father-in-law of the complainant. The complainant made omnibus and general allegation of demand of dowry and torture and she alleged that all the accused persons assaulted her and drove her out from the house.
The learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.44593 of 2019(2) dt.19-07-2019 2/2 petitioner is father-in-law of the complainant and there is no specific allegation against the petitioner. Petitioner has falsely been implication in the case on account of dispute between the husband and the wife and the entire family is made accused. Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur at Supaul in connection with Complaint Case No.49C of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
