For the Petitioner/s :
Mr.Atul Shankar, Adv For the Opposite Party/s :
Mr.Sunil Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 28-06-2021 Heard the parties in virtual Court.
Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A),304(B),201,120(B) of the I.P.C. and 3/4 of the Dowry Prohibition Act. Wife of the petitioner died within seven years of her marriage in the house of the petitioner in unnatural circumstances and there is allegation of demand of dowry and torture for the same.
Prayer for bail is on that ground that the parties have entered into a compromise.
Since the offence is not compoundable, considering the nature of allegation, I am not inclined to enlarge the petitioner on bail, who is in custody since 13.08.2020, in connection with Sonpur P.S.Case No.365 of 2017 pending in the court of learned C.J.M., Chapra at Saran.
There is no reason that the trial would not expedite if
Patna High Court CR. MISC. No.5400 of 2021(4) dt.28-06-2021 2/2 the parties have agreed for early disposal of the same. (Birendra Kumar, J) Nitesh/- U T
