The petitioners apprehend their arrest in Shivsagar P.S. Case No.48 of 2019 registered under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and Sections 3⁄4 of Prevention of Witch Craft Act.
The prayer for anticipatory bail of the petitioners was earlier rejected by order dated 30.04.2019 passed in Cr. Misc. No.28390 of 2019 but the petitioners again moved for grant of anticipatory bail on the ground that the informant has already compromised the case.
Taking into consideration the nature of allegation made against the petitioners, I am not inclined to reconsider the
Patna High Court CR. MISC. No.45821 of 2019(2) dt.31-07-2019 2/2 prayer for bail of the petitioners. Accordingly, the petition is once again rejected.
If the petitioners surrender in the court below, learned court below shall consider the regular bail of the petitioners taking into consideration the fact that the case is compromised and dispose of the regular bail of the petitioners preferably on the same day, if possible.
