JUSTICE SANJAY PRIYA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Haveli Kharagpur P.S. Case No. 116 of 2017 instituted for the offence under Sections 419 and 420 of the Indian Penal Code. The case of the prosecution is that this petitioner appeared in Bihar School Examination Board, Patna, in the year 2002 and 2016 by different name and date of birth. The document is enclosed with the written report wherein it is mentioned that the petitioner appeared in the Matriculation examination in the year 2016 with name Mojib Ansari and date of birth as 05.05.1995. He appeared earlier also in the Matriculation examination in the year 2002 with name Mojibur Rahman and date of birth mentioned as 28.02.87.

Patna High Court Cr.Misc. No.51757 of 2017 (2) dt.09-11-2017 2/2 Learned counsel for the informant has appeared and submitted that the petitioner has criminal antecedent also. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
