JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-07-2019 This application, for grant of anticipatory bail, arises out of Sangrampur P.S. Case No. 88/2019, disclosing offences under Sections 30(a), 32/37(C) of the Bihar Prohibition of Excise (Amendment ) Act, 2018.

Allegation as per F.I.R. is that police received secret information that petitioner and others are selling liquor in his house, went there and on seeing the police accused persons started fleeing away, however, one of them was caught and there recovery of 22 litres of liquor from the Aangan of the house of the petitioner.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and there was no recovery from his house and he has been made accused only on the confession of co-

Learned counsel for the state opposed the prayer for bail and submitted that the seizure list shows that there is recovery from the Aangan of the house of the petitioner. Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail.
