The petitioner seeks bail in Nawada (Town) P.S. Case No. 792/2018, instituted for offences under Section(s) 399, 402 and 411 of the Indian Penal Code read with Sections 25(1-b)a and 26 of Arms Act.

It is alleged in the written report that police apprehended four persons including this petitioner, after receiving information, on the basis of location of mobile phone, which was looted in Narhat (Sitamadhi) P.S. Case No. 262/2018. One person managed to run away. It is alleged that one loaded country made pistol has been recovered from possession of petitioner.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.46033 of 2019(2) dt.31-07-2019 2/2 petitioner is in custody since 27.10.2018.

The other co-accused has already been granted bail by this Court vide order dated 22.01.2019 passed in Cr. Misc. No. 2748/2019.

Keeping in view the period of custody spent by petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawada (Town) P.S. Case No. 792/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
