JUSTICE ARUN KUMAR ORAL ORDER 09-11-2017 Heard learned Counsel for the petitioners and the State. Petitioners apprehend arrest in connection with Barbigha (Mission O.P.) PS Case No. 366 of 2017 registered under Sections 448, 147, 148, 149, 323, 379 and 307 of the IPC. The allegation in brief is that the accused persons came and started assaulting the informant with fists and slaps and accused Pappu Ravidas is said to have given blow of iron rod and Naga Ravidas with a knife on the head of the informant and others assaulted with fists.

Learned Counsel for the petitioners submits that both sides are co-villagers and there is case and counter case between

Patna High Court Cr.Misc. No.53029 of 2017 (2) dt.09-11-2017 both sides for the same date of occurrence and the injury found on the person of the informant is simple in nature and also there is no allegation on any accused of assaulting by any deadly weapon to the informant's wife. The petitioners have clean antecedent.

Having considered the said facts and circumstances, the petitioners, namely, Pappu Ravidas, Doman Ravidas, Sharwan Ravidas, Manoj Ravidas, Indradev Ravidas and Mina Devi @ Moni Devi in the event of arrest or surrender before the court below within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM 3rd, Sheikhpura in connection with Barbigha (Mission O.P.) PS Case No. 366 of 2017 subject to conditions as laid down under Section 438(2) Cr.P.C..
