The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 427, 307 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons including the petitioner threatened and abused the informant and co-accused Jawahar Yadav and Bijo Yadav shot fired upon the informant, but said firing did not hit him.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.2.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. None is said to have been injured in

Patna High Court CR. MISC. No.48084 of 2019(3) dt.27-09-2019 2/2 course of occurrence. The allegation of firing upon the informant is against co-accused Jawahar Yadav and Bijo Yadav. No overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger in connection with Sessions case No.871A of 2012 arising out of Muffasil P.S. case No.315 of 1997.
