The petitioner seeks regular bail in connection with Sessions Trial No. 224 of 2014 arising out of Sherghati P.S. Case No. 87 of 2004 for the offence registered under Sections 385, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is not named in the First Information Report. The petitioner was remanded in this case on 21.04.2005 but he fled away from the jail custody on 18.02.2013 for which Civil Line

Patna High Court Cr.Misc. No.1919 of 2015 (2) dt.16-01-2015 2/2 Gaya P.S. Case No. 55 of 2013 was registered under Sections 224, 225, 120B of the Indian Penal Code. The petitioner was granted bail in the aforesaid case vide Cr. Misc. No. 41531 of 2014. The petitioner again remanded in this case on 01.07.2014 and since then he is in jail custody.

It appears that the petitioner has remained in jail for about eight years before he fled away from the jail custody and again he remained in jail for seven months in a case registered under Section 307 and other allied section of the Indian Penal Code.

Considering the facts aforesaid, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge- 2nd Gaya in connection with Sherghati P.S.
