2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 103, 61(2), 3(5) of the Bharatiya Nyaya Sanhita.
3. Prosecution case, in brief, is that on 30.03.2025 at about 8 PM, co-accused Raju Kumar Mukhiya came at the house of informant and took his son, namely, Raushan Kumar to the house of Bikau Mukhiya in the name of treatment and thereafter, his dead body was found in the wheat field of co-
Patna High Court CR. MISC. No.47027 of 2025(2) dt.27-08-2025 2/3 accused Jhagru Baitha. Informant suspects that all the F.I.R. named accused persons, including these petitioners, committed murder of his son.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. From perusal of the F.I.R. it is apparent that informant is not an eye witness of the occurrence and petitioners have been made accused merely on suspicion because they are family members of co-accused Bikau Mukhiya. He further submits that dead body of the deceased was found in the wheat field and petitioners have got no concern with the aforesaid wheat field. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application and submitted that petitioners are named in the F.I.R. and during course of investigation it was come that these petitioners were also involved in commission of the offence.
6. Considering the fact that only suspicion has been raised against the petitioners, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing
Patna High Court CR. MISC. No.47027 of 2025(2) dt.27-08-2025 3/3 bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Sitamarhi in connection with Riga P. S. Case No. 128 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
