JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 07.04.2014 in a case registered for the offence punishable under Section 393 of the Indian Penal Code.

Petitioner is named in the first information report but admittedly, he was not caught at the spot. No doubt, petitioner carries criminal antecedent of three cases but submission on behalf of the petitioner is that petitioner has been implicated in this case on account of enmity and village politics.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri R.K.
