1. Heard learned counsel for the petitioner, the learned counsel appearing on behalf of the informant and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 376, 504 and 506 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case by the informant. It is next submitted that in sum and substance, the informant alleges that petitioner on pretext of marriage established physical relation.

4. The learned counsel for the petitioner submits that petitioner never resiled from marriage rather some problems had

Patna High Court CR. MISC. No.50107 of 2024(4) dt.07-10-2024 2/2 arisen in the family on account of which, the marriage could not be performed, but then, it is submitted that he has convinced his family members that he wants to marry the informant.

5. The learned counsel appearing on behalf of the informant also submits that he has instructions not to oppose the anticipatory bail application of the petitioner as the petitioner on account of parental pressure was not able to marry the informant when he intended to marry her.

6. Considering the submissions made by the learned counsel for the informant, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bagaha, West Champaran in connection with Mahila (Bagaha) P. S. Case No.02 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
