The appellants seek pre arrest bail in connection with Turkauliya P.S.Case no.294 of 2017 registered for offences punishable under Sections 341, 323, 324, 307, 354B, 379, 504 & 509 of the Indian Penal Code and Section 3(i)(x) of SC/ST (Prevention of Atrocities) Act.
Allegation against the appellants is of abusing the informant and also calling 'Dian' to the informant and her mother. Further allegation is that they have assaulted the informant and also snatched Rs.5,000/- as well as ornaments of Rs.50,000/-. Submission of the learned counsel for the appellants is that no such occurrence has taken place and there are case and
Patna High Court CR. APP (SJ) No.3051 of 2017 (2) dt.07-11-2017 2/2 counter case between the parties and a counter case was also filed earlier to the present case, as such the present case and concocted case has been lodged.
Heard learned Special P.P. also.
Having heard both sides, this appeal is not maintainable.
Let the appellant surrender before the court of learned Special Judge and make prayer for regular bail, which will be considered by the learned Special Judge on the basis of the fact that there are case and counter case between the parties and also considering other materials he will dispose of the prayer for bail of the appellants if possible the same day.
With the above observation, this appeal is disposed of.
