This application for anticipatory bail arises out of Khagaria (Mufassil) P.S. Case No. 262 of 2019, disclosing offences under Sections 341, 323, 354, 504, 506 and 384 of the Indian Penal Code, read with Sections 25(1-b)a, 26 and 37 of the Arms Act.
It is alleged in the FIR that the petitioner entered into the house of the informant and threatened the family members of dire consequences. He was demanding a sum of Rs. 1,20,000/0 which the informant's husband had admittedly borrowed from him.
Learned counsel, appearing on behalf of the petitioner, has submitted that the case of the prosecution is
Patna High Court CR. MISC. No.47629 of 2019(2) dt.31-07-2019 2/2 concocted and it evident that no one has received any injury nor there is allegation of use of fire-arm.
Considering the above, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned CJM, Khagaria in connection with Khagaria (Mufassil) P.S. Case No. 262 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
